摘 要
“知情”，指了解事件的原委情状。《大清律例》中“知”出现 787 次，其中含“知情”二字的律文和例文为 305 条。本文对清代刑律中有关“知情”的条文进行梳理，分析、揭示“知情”在不同犯罪中的表现，研究行为人在实施犯罪行为之前或实施犯罪行为之时，对自己行为、行为的背景、行为的对象等是否知悉，进而思考清代刑律中知情对定罪量刑的影响。本文的主要内容有：
一、知情后行为人的行为表现。知情后的行为在立法与司法中是如何运用与体现的。
因知情的犯罪行为大体可分为故纵、藏匿与包庇三种主要行为，其中包庇与藏匿的行为表现略有相似之处，因此笔者在包庇行为中对其进行了相应的对比分析。
二、知情犯罪的主体分类。本文将主体分为官员、家属（亲戚）及平人三种，通过这三种类别划分出知情的不同罪行。并通过罪行的种类加以分析知情行为人在知晓案件情节后的行为对案件所产生的影响。
三、知情的定罪量刑分析。依据知情行为人的身份与行为方式的不同，通过清代法律并结合具体案例分析知情犯罪的定罪情形。并通过对行为人处罚方式的不同，分析是否为了通过刑的处罚起到一定的预防作用，以引导人的内心观念与规范人的行为。

ABSTRACT
"Informed" means to understand the circumstances of the event. The "Informed" in <The Great QingDecrees> appeared 787 times, including the "knowledge" of the two words of the law and the sample textof 305. In this paper, the provisions of the criminal law in the Qing dynasty about the "informed" carding,analysis, reveals the appearance of "Informed" in different crime, the offender commits a crime, or beforeimplementation of the crime, the background of his own behavior, behavior, the behavior of objects such asaware, then think about the law in the Qing dynasty in the knowledge of the influence of the criterions forthe conviction. The main contents of this paper are:
First, The behavior of the actor after the knowledge. How the informed behavior is applied andreflected in legislation and judicature. Because knowledge of crime can be divided into the three mainbehavior, longitudinal, hiding and shield the hide and behave somewhat similarities, so the author in the actof shielding on the corresponding analysis.
Second, the Subject classification of informed crime. This paper divides the subjects into threecategories: officials, family members (relatives) and ping people, and the different crimes of knowledge areclassified through these three categories. And through the types of crimes, we can analyze the influence ofthe informed agent on the case after knowing the plot of the case.
Third. Informed conviction and sentencing analysis. According to the difference of the identity andbehavior of the person with knowledge of the situation, the conviction situation of informed crime wasanalyzed through the Qing dynasty law and the concrete cases. In addition, through the differentpunishment methods of the actor, it is analyzed whether the punishment of the punishment plays a certainrole in the prevention of the punishment, so as to guide the person's inner concept and the behavior of thestandard person.
